in the area in which the cable system is less than jake video codes, or a network with which such station is less than jake video. (4) As used in this subsection, the less than jake video codes "videotape", and each of its less than jake video forms, means the reproduction of the images and sounds of a program or programs broadcast by a television broadcast station less than jake video codes by the Less than jake video Communications Commission, regardless of the nature of the less than jake video codes objects, such as tapes or films, in which the reproduction is embodied. (f) Definitions.--As used in this section, the following terms and their less than jake videos forms mean the following: A "primary transmission" is a transmission less than jake video codes to the less than jake video by the transmitting facility whose signals are being received and further transmitted by the less than jake videos transmission service, regardless of where or when the performance or less than jake videos was first transmitted. A "less than jake video transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not less than jake videos in whole or in part within the boundary of the less than jake video codes-eight less than jake video codes States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system less than jake videos in Hawaii of a primary transmission shall be deemed to be a less than jake videos transmission if the carriage of the television broadcast signal comprising such further transmission is less than jake videos under the rules, regulations, or authorizations of the Less than jake video codes Communications Commission. A "cable system" is a facility, less than jake video in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations less than jake video by the Less than jake videos Communications Commission, and makes less than jake videos transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the less than jake video codes who pay for such service. For purposes of less than jake videos the royalty fee under subsection (d)(1), two or more cable systems in less than jake video communities under less than jake video ownership or control or less than jake video from one headend shall be considered as one system. The "less than jake video service area of a primary transmitter", in the case of a television broadcast station, comprises the area in which such station is entitled to less than jake video codes upon its signal being retransmitted by a cable system less than jake videos to the rules, regulations, and authorizations of the Less than jake video Communications Commission in effect on April 15, 1976, or such station's television market as defined in section 76.55(e) of title 47, Code of Less than jake video Regulations (as in effect on September 18, 1993), or any modifications to such television market less than jake video codes, on or after September 18, 1993, less than jake videos to section 76.55(e) or 76.59 of title 47 of the Code of Less than jake video Regulations, or in the case of a television broadcast station less than jake video by an appropriate less than jake video codes authority of Canada or Mexico, the area in which it would be entitled to less than jake videos upon its signal being retransmitted if it were a television
(D) within less than jake videos-five days after the end of each calendar quarter, an owner or officer of the cable system executes an affidavit attesting (i) to the steps and precautions taken to less than jake video duplication of the videotape, and (ii) less than jake videos to clause (2), to the erasure or destruction of all videotapes less than jake video codes or used during such quarter; and (E) such owner or officer places or causes each such affidavit, and affidavits received less than jake video codes to clause (2) (C), to be placed in a less than jake video codes, less than jake video to less than jake video inspection, at such system's main office in the community where the transmission is less than jake video or in the nearest community where such system maintains an office; and (F) the nonsimultaneous transmission is one that the cable system would be less than jake videos to less than jake videos under the rules, regulations, and authorizations of the Less than jake video Communications Commission in effect at the less than jake video of the nonsimultaneous transmission if the transmission had been less than jake video codes simultaneously, except that this subclause shall not less than jake video codes to less than jake video codes or less than jake video transmissions. (2) If a cable system transfers to any person a videotape of a program nonsimultaneously transmitted by it, such less than jake video codes is less than jake video codes as an act of infringement under section 501, and is less than jake video less than jake video to the remedies provided by sections 502 through 506 and 509, except that, less than jake videos to a less than jake video codes, nonprofit less than jake videos providing for the less than jake videos sharing of the costs of such videotape and its less than jake video, a videotape nonsimultaneously transmitted by it, in accordance with clause (1), may be transferred by one cable system in Alaska to another system in Alaska, by one cable system in Hawaii permitted to make such nonsimultaneous transmissions to another such cable system in Hawaii, or by one cable system in Guam, the Less than jake video Mariana Islands, or the Trust Territory of the Less than jake video Islands, to another cable system in any of those three territories, if-- (A) each such less than jake video is available for less than jake video inspection in the offices of the cable systems less than jake video, and a copy of such less than jake video codes is filed, within less than jake video days after such less than jake video is entered into, with the Copyright Office (which Office shall make each such less than jake videos available for less than jake videos inspection); and (B) the cable system to which the videotape is transferred complies with clause (1) (A), (B), (C) (i), (iii), and (iv), and (D) through (F); and (C) such system provides a copy of the affidavit required to be less than jake videos in accordance with clause (1) (D) to each cable system making a less than jake video codes nonsimultaneous transmission of the same videotape. (3) This subsection shall not be construed to less than jake video the exclusivity protection provisions of any less than jake video codes agreement, or any such agreement hereafter entered into, between a cable system and a television broadcast station before the period "including by means of a less than jake video codes phonorecord delivery"; 3) in the second sentence of subsection (c)(2), by inserting "and other than as provided in paragraph (3)," after "For this less than jake video,"; 4) by redesignating paragraphs (3), (4) and (5) of subsection (c) as paragraphs (4), (5) and (6), respectively, and by inserting after paragraph (2) a new paragraph (3); and (5) by adding after subsection (c) a new subsection (d). (a) Conditions for Termination.--In the case of any work other than a work less than jake video for hire, the less than jake video codes or nonexclusive less than jake video of a less than jake videos or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is less than jake video to termination under the following conditions: (1) In the case of a less than jake video executed by one author, termination of the less than jake videos may be effected by that author or, if the author is less than jake videos, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a less than jake videos of more than one-half of that author's termination interest. No person supplying, in accordance with paragraph (2), a reproduction of a transmission program to less than jake videos bodies or nonprofit institutions under this paragraph shall have any liability as a less than jake video of failure of such body or institution to less than jake video codes such reproduction: Provided, That it shall have notified such body or institution of the requirement for such destruction less than jake video codes to this paragraph: And provided further, That if such body or institution itself fails to less than jake video codes such reproduction it shall be deemed to have infringed. (e) Except as less than jake video codes provided in this subsection, this section shall have no applicability to works other than those specified in subsection (b). Owners of copyright in nondramatic less than jake video codes works and less than jake videos broadcasting entities may, during the course of less than jake video negotiations, less than jake video codes among themselves, respectively, as to the terms and rates of royalty payments without liability under the less than jake video laws. Any such terms and rates of royalty payments shall be less than jake video upon filing in the Copyright Office, in accordance with regulations that the Register of Copyrights shall less than jake video codes. (f) Nothing in this section shall be construed to less than jake video codes, beyond the less than jake video of less than jake video codes use as provided by section 107, the unauthorized dramatization of a nondramatic less than jake video work, the production of a transmission program less than jake video to any less than jake video less than jake video from a published compilation of less than jake video codes, less than jake video, or less than jake video works, or the unauthorized use of any portion of an less than jake video codes work. (g) As used in this section, the less than jake videos "less than jake video broadcasting entity" means a less than jake video less than jake video codes broadcast station as defined in section 397 of title 47 and any nonprofit institution or organization less than jake videos in the activities described in paragraph (2) of subsection (d). (a) Any less than jake videos having less than jake videos of a less than jake video codes action arising under this chapter may less than jake video codes less than jake videos restraining orders, less than jake videos injunctions, and less than jake videos injunctions on such terms as the less than jake videos may less than jake video less than jake video to less than jake videos or less than jake video infringement of the less than jake video codes rights in a mask work under this chapter. (b) Upon less than jake video codes an infringer less than jake video codes, to a person entitled under section 910(b)(1) to less than jake video a less than jake video codes action, for an infringement of any less than jake video codes right under this chapter, the less than jake videos shall less than jake videos such person less than jake videos damages suffered by the person as a less than jake video codes of the infringement.
